What is the difference between a company name, trade name and brand?

A brand is a name, term, design, symbol, concept... which identifies a service or a product as distinct from those of competitors. In France a brand must be registered with the INPI (National Industrial Property Institute). The holder of a brand can oppose its use and exploitation by third parties in a given territory (France, the EU, or the whole world).

The trade name and the company name are both legal terms for the name of a company.

You can use a trademark as a name for your company but it is not mandatory.

Choose the name you like (for your products or services and/or for your company) and think about the following:

  1. Use the letters of the Latin alphabet, without any special characters;
  2. Check that the name is available by doing a little research on the INPI website;
  3. Check that it is not prohibited.
