Patent protection in France : towards a more robust protection regime to foster innovation

SMEs are central to the strategic innovation and attractiveness policies of France. Some modifications were made to the recently adopted law « PACTE » on corporate growth and transformation which was enacted in May 2019 to introduce a new patent protection system, more secure and sophisticated than the previous one.

The new French patent aims at contributing greatly to the stimulation of innovation and research in France and promoting its IP protection system in view of the fierce competition between the most inventive countries worldwide.

In order to have a more robust regime, stricter requirements will be implemented with the establishment of rigorous standards of inventiveness and novelty for the issuance of a patent by the French National Industrial Property Institute.
